  1. PURPOSES OF USE, STORAGE PERIOD, PROVISION OF DATA

2.1 Contact

If you contact us, the data you provide will be stored by us for 6 months for the purpose of processing the enquiry and in case of follow-up questions. We do not pass on this data without your consent. We process and use personal data for the purposes agreed with you and in compliance with the relevant data protection regulations. We only collect personal data that is necessary for the performance of our services, service and user benefits or that you have voluntarily provided to us. We carry out processing operations that are essential for you as a client, interested party, supplier, website visitor.

The personal data (master and contact data) are necessary for the performance of the contract and are also processed to comply with legal obligations (e.g. tax retention obligations). We store the data during the customer relationship and beyond for a period of at least 7 years after termination of the same, in particular in order to be able to fulfil tax retention obligations.

Data is only passed on to the extent necessary for the processing of the contract and in accordance with the interests of the person concerned. Such as, for example, to order processors who are active within the framework of a contractual relationship in the processing of the contract (e.g. shipping companies) or are active within the framework of IT services (providers in communication, companies within the framework of the support of the IT systems) or auditors, tax consultants, lawyers, authorities.

We would like to point out that photos are taken at events, which are published on our website and printed materials at most for the purpose of documenting the event. The processing of this data is based on legitimate interest, namely self-promotion, and you have the right to object to this processing.

2.2 Information
If you contact us, e.g. by e-mail or in any other way (e.g. by telephone, post), we will store your details for the purpose of processing your enquiry for as long as it is necessary for the purpose and there are no legal obligations to retain data that prevent deletion.

2.3 Supplier and client management
We receive the data from you in the context of the relationship as a supplier and/or contractor of our company. This data is necessary for the fulfilment of the contract and is also processed to comply with legal obligations (e.g. tax retention obligations or warranty and compensation obligations).

2.4 Contact form on the website (for submitting and answering queries)

You can also send us enquiries about our services or general enquiries through a contact form on the website, by email or in any other way. The data you provide to us in this way will then be used to respond to your enquiry. We will only use your personal data to process your enquiry.

The legal basis for this is the initiation of a contract as well as a contractual basis for existing customers, legal obligations and the legitimate interest in the proper care of existing or potential customers, interested parties, suppliers. This data is only passed on to order processors or if this is necessary for the fulfilment of the contract. You are not obliged to provide the data. If you do not provide the data, then we cannot process the request.

2.4 Newsletter and Marketing

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. No further data will be collected. We use this data exclusively for sending the requested information and do not pass it on to third parties.

You can revoke your consent to the storage of the data, the e-mail address and their use for sending the newsletter at any time, for example via the "unsubscribe" link in the newsletter.

2.4.1 Newsletter content and registration data

We only send newsletters with the consent of the recipients or on the basis of a legal permission. Our newsletters inform you about offers and events, as well as interesting technical articles and practical tips. We collect your e-mail address for our newsletter service. By subscribing to one of our newsletters, you agree to receive it and to the procedures described. 

2.4.2 Double opt-in and logging

Registration for our newsletters takes place in a so-called double opt-in process. After registration, you will therefore receive an e-mail asking you to confirm your registration. This confirmation is necessary to prevent registration with third-party email addresses. We log the registrations for the newsletter in order to be able to prove the registration process in accordance with the legal requirements. 

2.4.3 Unsubscribe / Revoke

The newsletter is sent on the basis of your consent in accordance with Art 6 Para 1 lit a and Para 7 DSGVO. You can unsubscribe from our newsletters at any time. You can send us an email with the subject "Unsubscribe". We will then delete your data that we have processed in connection with the newsletter dispatch.

2.5. WEBSITE ANALYSIS, USE OF COOKIES & SERVICES FROM GOOGLE INC.

When you visit our website, your IP address, start and end of session are recorded for the duration of this session. This is for technical reasons and enables you to use a shopping cart, among other things. Therefore, it constitutes a legitimate interest according to Art 6 (1) (f) DSGVO.  We operate an analysis tool on our website in order to improve the website and provide you with more targeted information, as well as to ensure the resilience and availability of our website and to guarantee IT security.

2.5.1 Google Analytics

Our website uses Google Analytics, a web analytics service provided by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Cookies are used in the process. These are small text files that are stored on your computer and enable an analysis of the use of our website. The information generated by the cookie about your use of our website is mostly transmitted to Google servers in the USA and stored there.

2.5.1.1 Privacy policy of Google

2.5.1.2 IP anonymisation
The IP anonymisation function is activated on our website. This means that your IP address is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to the USA and shortened there. Google Inc. acts on our behalf and will use this information to evaluate the use of our website and subsequently compile reports on website activity. Google Inc. may also use this data to provide other services relating to website usage to VARGAS BRUN Gastronomie und Consulting GmbH. However, the IP address transmitted by your browser will not be merged with other Google data.

2.5.1.3 Demographic characteristics in Google Analytics

In addition, our website uses the demographic characteristics function of Google Analytics. Among other things, this allows reports to be created that provide information on the age, gender and interests of visitors to the site. This helps us to adapt our advertising activities accordingly. The origin of this is in interest-based advertising from Google Inc. as well as in visitor data from third-party providers. However, this data cannot be assigned to a specific person. You can deactivate this function at any time via the ad settings in your Google account. 

2.5.1.4 Browser plugin
You can also prevent the storage of cookies by selecting the appropriate settings on your browser. However, we would like to point out that in this case you may not be able to use all the functions of our website to their full extent. 

2.5.2 Google Analytics Remarketing
Our website also uses the functions of Google Analytics Remarketing in conjunction with the cross-device functions of Google Ads. The provider here is again Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. This function enables us to connect the target groups created with Google Analytics Remarketing with the cross-device functions of Google Ads and thus create interest-based, personalised advertising content and play it everywhere. This content may also be based on information about your past usage and browsing behaviour. If you have given consent, Google will link your web and app browsing history to your Google Account for this purpose. This makes it possible for the same personalised advertising message to be displayed on each end device on which you log in with your Google account. To enable this feature, Google Analytics collects Google-authenticated IDs of users, which are temporarily linked to our Google Analytics data to define and create target groups for cross-device ad advertising.

2.5.3 Google Ads and Google Conversion-Tracking
In addition, our website uses the functions of Google Ads. This is an online advertising programme of Google Inc. at 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States. In the course of Google Ads, so-called conversion tracking is used. When you click on an ad placed by Google, a cookie is set for conversion tracking. Cookies are small text files that your browser stores on your computer. After 30 days, these cookies lose their validity and are not used to personally identify users. If the user visits certain pages of our website and the cookie has not yet expired, Google and we can recognise that the user has previously clicked once on the ad and was redirected to this page. The information obtained by the conversion cookie is only used to create conversion statistics for Google Ads customers, i.e. in this case VARGAS BRUN Gastronomie und Consulting GmbH. We thus learn the total number of users who clicked on our ad and were redirected to a page tagged with a conversion tracking tag. However, we never receive information that would allow us to identify users personally. If you do not wish to participate in the tracking, you can also object to this use here. You can do this by deactivating the Google conversion tracking cookie via your internet browser under user settings. Your clicks will then not be included in the conversion tracking statistics.

2.5.4 Google Maps

By using this service, our location is shown to you and a possible journey is made easier. VARGAS BRUN Gastronomie und Consulting GmbH maintains some online presences within various social networks and platforms in order to communicate with the users active there and to inform them about our services. We would like to point out at this point that data may be used outside the European Union. This could result in certain risks for the users of these platforms, among other things, the enforcement of the rights of the users may become significantly more difficult. With regard to providers from the USA that are certified under the Privacy Shield, it can be assumed that they undertake to comply with EU data protection standards. It may happen that users' data are processed for market research and advertising purposes. It is on some of these social networks, which base their business model on paid advertising, that user behaviour and interests are grouped and aggregated into target groups. These can then be used by companies such as VARGAS BRUN Gastronomie und Consulting GmbH to play out personalised and individually adapted advertising. As a rule, cookies are also stored on the user's computer and thus their usage behaviour and interests are saved.

3.1 Facebook Pixel, Facebook Custom Audiences and Facebook-Conversion

We use the so-called Facebook pixel of the social networking platform Facebook, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or, where applicable, by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. Through the Facebook pixel, it is possible for Facebook to determine you as a user of our online offer and as a target group for the display of advertisements. VARGAS BRUN Gastronomie und Consulting GmbH therefore uses the Facebook pixel to display the ads only to those Facebook users who have also shown an interest in the products of VARGAS BRUN Gastronomie und Consulting GmbH or who have certain characteristics (e.g. interests in certain topics). These characteristics are transmitted by us to Facebook in advance and combined in so-called Custom Audiences. By integrating the Facebook pixel, we can thus ensure that our advertisements correspond to the potential interest of Facebook users and do not have a harassing effect. Furthermore, the use of the Facebook pixel allows us to track the effectiveness of the Facebook ads for statistical and market research purposes. 3.2 Instagram

We also use the services of the social platform Instagram, which is operated by Instagram Inc, 1601 Willow Road, Menlo Park, CA, 94025, USA. This may include any content such as images, videos or texts that allow you to share your likes, subscribe to the content creators or our posts. If you are a user on the Instagram platform, Instagram can assign the call of the above-mentioned content and functions to your profile and use it for advertising purposes.

3.3 Youtube

In addition, we embed some of our videos on the YouTube platform of the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, or Google Ireland Limited, Gordon House, Barrow Street Dublin 4, Ireland. When you visit one of our pages equipped with a YouTube plugin and watch a video, a connection to the YouTube servers is established. This tells the YouTube server which of our pages you have already visited. If you are logged into your YouTube account, you thus enable YouTube to assign your surfing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.

We use external service providers to handle the payment processes. Their platforms enable a smooth ordering and payment process for you as a customer and for us as an online shop operator. In order to enable a payment, the payment service providers mentioned below process various data, such as name, address, bank data (account number or credit card number). Without the processing of this data, the online processing of the payment process is not possible. The processing of the data takes place at the payment service provider and we do not receive any account or credit card related information. Please refer to the respective terms and conditions and data protection information of the provider used on their website. You will find a link to this at the end of this paragraph.
